1. Who we are

Stubborn Dog Coffee ("Stubborn Dog," "we," "us") is a small-batch coffee roasting business operated by Timothy C Ferman as a sole proprietorship in the State of Idaho under the assumed business name "Stubborn Dog Coffee." These Terms of Service govern your use of stubborndog.coffee (the "Site") and any purchase you make through it. By browsing the Site or placing an order, you agree to these terms. If you do not agree, please do not use the Site.

We may update these terms at any time. The version posted on the Site at the moment you place an order is the version that applies to that order.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm that you meet that requirement and that the payment method you use is yours to use.

3. Products, descriptions, and availability

We sell roasted coffee in limited quantities. Because we buy single lots of green coffee and roast in small batches, any given coffee is available only while that lot lasts. We may change, limit, or discontinue a product at any time without notice.

We work to describe our coffees accurately, including origin, process, and tasting notes. Tasting notes describe flavors our palate finds in the cup; they do not mean the coffee contains those ingredients. Roast color, grind, and cup character vary naturally from batch to batch. Product photography is representative, and actual bags and beans may differ slightly in appearance.

4. Pricing and payment

All prices are in U.S. dollars and are subject to change without notice. Idaho sales tax is applied where required. Payment is processed through Shopify's payment providers; we do not store your full payment card details.

We reserve the right to refuse or cancel any order, including orders that appear fraudulent, orders placed at a price listed in error, and orders that exceed reasonable quantities for personal use. If we cancel an order you have already paid for, we will refund it in full.

5. Orders and fulfillment

Placing an order is an offer to buy. An order is accepted when we ship it, not when the confirmation email is sent. Shipping terms, timing, and destinations are set out in our Shipping Policy, which is part of these terms.

6. Returns and refunds

Because coffee is a perishable food product, we do not accept returns or exchanges on roasted coffee.

We will replace or refund any order that arrives damaged, is defective, or is not what you ordered. Contact us at hello@stubborndog.coffee within 14 days of delivery and include your order number and a photo of the problem. We handle these case by case and we'd rather make it right than argue about it.

7. Food safety and allergens

Our coffee is roasted and packaged in a shared facility. We cannot guarantee that our products are free from cross-contact with allergens handled elsewhere in that facility. Coffee contains caffeine. If you have a medical condition or are pregnant, talk to your doctor about caffeine intake.

Nothing on this Site is a health claim. We make no representation that coffee prevents, treats, or cures any condition.

8. Certifications and origin claims

We describe where our coffee comes from, including certifications held at the farm or mill level, only as factual information about the green coffee we purchase. Stubborn Dog Coffee is not itself a certified organic handler, a Fair Trade licensee, or a Regenerative Organic Certified operation, and we do not represent our finished retail products as certified under those programs.

9. Your account and conduct

If you create an account, you are responsible for keeping your login credentials secure and for all activity under your account. You agree not to use the Site to break the law, to interfere with its operation, to scrape or harvest data from it, or to resell our products without our written permission.

10. Intellectual property

The Stubborn Dog name, logo, packaging design, photography, and Site content are our property or used under license, and are protected by copyright and trademark law. You may not use them without our written permission.

11. Third-party links and services

The Site runs on Shopify and may link to or rely on third-party services. We are not responsible for the content, policies, or practices of any third party.

12. Disclaimer of warranties

The Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of your purchase or your use of the Site is limited to the amount you paid for the order the claim relates to. We are not liable for indirect, incidental, consequential, or punitive damages. Some states do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Stubborn Dog Coffee and its owner from any claim arising out of your breach of these terms or your misuse of the Site.

15. Governing law and disputes

These terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Ada County, Idaho, and you consent to that venue.

Before filing anything, email us at hello@stubborndog.coffee. Most problems are a shipping mishap and take one message to fix.

16. Severability and entire agreement

If any provision of these terms is found unenforceable, the rest remain in effect. These terms, together with our Shipping Policy, Refund Policy, and Privacy Policy, are the entire agreement between you and us regarding the Site.
